Limitation of Liability

This Limitation of Liability explains the extent to which GoBaguio Hub and hosts are responsible for events, losses, and issues arising from the use of the platform and any bookings made through it. By using GoBaguio Hub, you agree to the terms on this page.

1. Platform Role

GoBaguio Hub primarily acts as an online platform that allows hosts to list accommodations or services and guests to discover and book them. Unless expressly stated, GoBaguio Hub is not the owner, operator, or manager of the listed properties and does not control the day-to-day operations of hosts.

2. No Guarantee of Listings

While GoBaguio Hub encourages accurate information, it does not guarantee that every listing, description, photo, or amenity detail is complete, current, or error-free. Hosts are responsible for the accuracy of their listings. Guests should review all available information and, where needed, clarify important details directly with the host before booking.

3. Service Interruptions and Technical Issues

GoBaguio Hub may occasionally be unavailable due to maintenance, updates, technical issues, or circumstances beyond its control. While reasonable efforts are made to keep the platform functional, GoBaguio Hub does not guarantee continuous, uninterrupted access and is not liable for any losses that may result from temporary unavailability or technical errors.

4. Indirect and Consequential Damages

To the maximum extent permitted by applicable law, GoBaguio Hub, its owners, and its team are not liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, loss of data, loss of business opportunities, or other intangible losses resulting from the use of or inability to use the platform or any booking made through it.

5. Host Responsibilities and Liability

Hosts are solely responsible for the condition, safety, legality, and suitability of their properties or services. Any claims, damages, injuries, or losses arising from a guest’s stay or experience at a property are generally between the guest and the host. GoBaguio Hub is not a party to the accommodation or service contract between guest and host, unless explicitly stated otherwise.

6. Guest Responsibilities

Guests are responsible for using the property or service in a reasonable and lawful manner, following house rules and local regulations. Any damage, misconduct, or violation caused by the guest or their companions may result in penalties, additional charges, or the termination of the stay, as determined by the host and applicable law.

7. Third-Party Services

Some parts of the booking or payment process may rely on third-party services, such as payment providers, banks, or communication tools. GoBaguio Hub does not control these third parties and is not responsible for their actions, errors, or failures. Any issues directly related to third-party systems should be addressed with the relevant provider.

8. Maximum Aggregate Liability

Where GoBaguio Hub is found to be directly liable to a user despite the limitations above, and to the extent allowed by law, the maximum aggregate liability of GoBaguio Hub in connection with any single booking or series of related events is limited to the total amount of platform fees, if any, paid by the user to GoBaguio Hub for that booking.

9. Local Laws and Non-Excludable Rights

Some jurisdictions do not allow certain disclaimers or limitations of liability. In those cases, portions of this clause may not apply to you. However, the limitations will apply to the fullest extent permitted by the laws that govern your use of the platform and your booking.

10. Acceptance of This Clause

By browsing the site, creating an account, or confirming a booking through GoBaguio Hub, you acknowledge that you have read, understood, and agreed to this Limitation of Liability, in addition to the Terms and Conditions and other applicable policies.
